These Terms and Conditions ("Agreement") govern the use of services provided by Likhang Maya ("we," "us," or "our"). By accessing or using our services, you agree to the following terms:
1. Services
1.1 Likhang Maya provides creative design services, including but not limited to graphic design, web design, branding, animation, social media content, print materials, and more. 1.2 All services are offered on a subscription model with unlimited design requests and revisions, as per the selected service tier.
2. Process and Workflow
2.1 Our process includes an initial consultation, concept development, revisions, and final delivery. Each project follows the workflow outlined in the subscription plan. 2.2 We strive for a turnaround time of 24-48 hours for design requests, though the actual timeframe may vary based on complexity. 2.3 Clear communication and prompt feedback are crucial to the timely delivery of services. Delays in providing necessary materials or feedback may affect the delivery timeline.
3. Client Responsibilities
3.1 You agree to provide accurate and timely information, materials, and feedback essential for the successful completion of design requests. 3.2 You are responsible for approving all final deliverables. Once approval is given, Likhang Mayawill not be held responsible for any errors.
4. Revisions
4.1 All services include unlimited revisions within reasonable use, provided the requests are within the scope of the selected subscription plan. 4.2 Significant changes in scope or direction may require additional discussion and adjustment to delivery timelines.
5. Pricing and Payment Terms
5.1 Our services are billed on a subscription basis, with pricing based on the selected plan (e.g., Starter, Pro, Custom). 5.2 Payments are due monthly in advance, and services will be active for the duration of the subscription term. 5.3 Non-payment will result in suspension or termination of services. Services will resume once the outstanding payment has been received. 5.4 We accept payment via credit card, PayPal, or bank transfer. 5.5 Pricing is subject to change. Any changes will be communicated to clients in advance and will apply upon renewal of the subscription term.
6. Intellectual Property Rights
6.1 Upon full payment, ownership of the final design deliverables will be transferred to you. Third-party assets (e.g., stock photos, fonts) used in the designs may be subject to separate licensing agreements. 6.2 Likhang Maya reserves the right to use completed designs in our portfolio, on our website, and for marketing purposes unless otherwise requested in writing.
7. Cancellation and Termination
7.1 You may cancel your subscription at any time, with the cancellation taking effect at the end of the current billing cycle. No refunds will be provided for partial months. 7.2 We reserve the right to terminate your subscription or service if you breach these Terms or fail to make required payments.
8. Confidentiality
8.1 Both parties agree to maintain confidentiality of any proprietary or sensitive information shared during the course of the project. 8.2 We will not disclose or share confidential project information without your written consent.
9. Liability
9.1 We are not liable for any losses or damages arising from the use of designs once the final deliverables are approved. 9.2 You agree to indemnify Likhang Maya against any legal claims or liabilities arising from the use of our designs post-delivery.
10. Portfolio and Publicity
10.1 We reserve the right to showcase completed work in our portfolio and promotional materials unless you provide written notice to restrict use. 10.2 Sensitive or proprietary content must be communicated before project initiation if you wish to prevent its inclusion in our portfolio.
11. Amendments to Terms
11.1 Likhang Maya reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to you in advance, and continued use of our services after such modifications will constitute your acceptance of the revised terms. 11.2 The most current version of these Terms will always be available on our website.
12. Governing Law
12.1 These Terms are governed by and construed in accordance with the laws of Ontario, Canada. 12.2 Any disputes arising under these Terms will be resolved through mediation or arbitration in Sault Ste. Marie, Ontario.
